Terms of Service

1. Acceptance of Terms

By accessing or using SpyGuard (“Service”, “App”), you (“User”, “you”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and SpyGuard Technologies Pvt. Ltd. (“Company”, “we”, “us”).

2. Description of Service

SpyGuard is a parental monitoring application for Android devices. The Service includes: real-time GPS location tracking, screen time management, call and SMS monitoring, social media activity monitoring, SOS emergency alerts, and remote device management. The Service is accessible via web dashboard (parent portal) and Android app (child device app).

3. Legal Usage Requirements

You MUST meet ALL of the following conditions to use SpyGuard legally:

  • Parental Status: You are the parent or legal guardian of the child being monitored
  • Minor Child: The child being monitored is under 18 years of age
  • Device Ownership: You own the device being monitored, or you have the device owner's explicit written consent
  • Device Access: You have physical access to the device to install and configure the app
  • Indian Jurisdiction: You are using the Service within India (we do not support monitoring across state lines or international boundaries without local legal counsel)

PROHIBITED USES: Monitoring spouses or partners without consent, monitoring employees without disclosure, monitoring adult family members without consent, monitoring yourself (self-surveillance), using in any jurisdiction where such monitoring is illegal, or using to facilitate illegal activities. Violation of these requirements results in immediate account termination without refund.

4. Account Registration

To use SpyGuard, you must:

  • Be at least 18 years old
  • Provide accurate, current personal information
  • Verify your email address via confirmation link
  • Create a strong password (minimum 8 characters, mixed case, numbers)
  • Enable two-factor authentication (2FA) for enhanced security
  • Accept these Terms and Privacy Policy

You are responsible for maintaining confidentiality of your login credentials and for all activities under your account. Notify us immediately of unauthorized access at security@spyguard.in.

5. Subscription & Billing

Available Plans:

  • Basic: ₹299/month or ₹2,390/year - 1 child device, core features
  • Premium: ₹599/month or ₹4,790/year - 3 child devices, all features
  • Ultimate: ₹999/month or ₹7,990/year - 5 child devices, priority support

Billing Terms:

  • Subscriptions are billed in advance (monthly or annually)
  • Annual plans save 33% compared to monthly billing
  • All prices are in Indian Rupees (INR) and include GST
  • Payments processed securely via Razorpay (PCI-DSS compliant)
  • Failed payments result in service suspension after 7 days
  • Price changes apply at next billing cycle with 30 days notice

Renewal: Subscriptions auto-renew unless cancelled 24 hours before billing date. Cancellation takes effect at end of current billing period.

6. Cancellation & Refunds

How to Cancel:

  • Log into your account at app.spyguard.in
  • Go to Settings → Subscription → Cancel Subscription
  • Confirm cancellation on next billing date
  • Remove SpyGuard app from child devices

Refund Policy:

  • 7-day money-back guarantee for new annual subscriptions
  • Monthly plans are non-refundable after billing cycle starts
  • Partial month refunds are not provided
  • Refunds for Terms violations are denied
  • Refund requests: support@spyguard.in with account email

7. Acceptable Use Policy

You MAY:

  • Monitor your minor children's Android devices legally
  • Set screen time limits and app restrictions
  • Track location and set geofencing alerts
  • View call logs and messages for child safety
  • Receive SOS alerts and emergency notifications
  • Use data for honest conversations with your children

You MAY NOT:

  • Use for stalking, harassment, or surveillance of any kind
  • Monitor devices without proper authorization
  • Use data to control, manipulate, or abuse anyone
  • Share monitoring data with third parties
  • Attempt to bypass device security or encryption
  • Use automated scripts or bots to access the Service
  • Resell, redistribute, or sublicense the Service
  • Use for any illegal purpose under Indian law

8. Service Level & Availability

Uptime Commitment:

  • Target: 99.9% monthly uptime for API and dashboard
  • Scheduled maintenance announced 48 hours in advance
  • Emergency maintenance may occur without notice
  • Downtime credits not provided for maintenance windows

Device App: SpyGuard app must remain installed and granted permissions. Battery optimization settings may need adjustment on some Android devices (Xiaomi, Realme, Vivo, Samsung, OnePlus, POCO, Oppo) for uninterrupted monitoring. We provide setup guides for OEM-specific configurations.

9. Intellectual Property

SpyGuard name, logo, design, code, documentation, and all content are proprietary to SpyGuard Technologies Pvt. Ltd. You receive a limited, non-exclusive, non-transferable license to use the Service. Reverse engineering, decompilation, or bypassing security measures is prohibited. All monitoring data belongs to the parent account holder.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES. WE DO NOT GUARANTEE UNINTERRUPTED MONITORING, 100% LOCATION ACCURACY, OR ERROR-FREE OPERATION. WE ARE NOT LIABLE FOR: INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, REVENUE, OR PROFITS; ACTIONS TAKEN BASED ON MONITORING DATA; DEVICE COMPATIBILITY ISSUES; OR THIRD-PARTY SERVICE FAILURES. OUR TOTAL LIABILITY IS LIMITED TO FEES PAID IN THE LAST 12 MONTHS.

11. Indemnification

You agree to indemnify, defend, and hold harmless SpyGuard Technologies Pvt. Ltd., its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: your use of the Service, your violation of these Terms, your violation of applicable laws, or your monitoring of individuals without proper authorization.

12. Account Termination

We may suspend or terminate your account immediately, without notice, if you:

  • Violate these Terms or Legal Usage Requirements
  • Use the Service for illegal activities
  • Attempt to hack, abuse, or exploit the Service
  • Fail to pay subscription fees
  • Pose a risk to our systems or other users

Terminated accounts are not eligible for refunds. We may retain data as required by law.

13. Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka, India. Before filing any dispute, you agree to attempt resolution through mediation. For disputes under ₹20 lakhs, parties shall attempt mandatory conciliation under the Mediation Act, 2023 before approaching courts.

14. Modifications to Terms

We may modify these Terms at any time. Material changes will be notified via email and dashboard notification at least 30 days before taking effect. Continued use after changes constitutes acceptance of new Terms. If you disagree with changes, you must cancel your subscription before the effective date.
